Official Contest
Rules
These
contest rules are specific to the above contest conducted by Entercom Buffalo,
LLC d/b/a WTSS (collectively, the “Station”). Except to the extent specifically set forth
below with respect to this specific contest, the Station’s general contest
rules apply to this contest as well. A
copy of these specific contest rules and the Station’s general contest rules
are available at the Station’s studio at 500 Corporate Parkway, Suite 200,
Amherst, NY 14226 during regular business hours and on the contest page on the
Station’s website at www.mystar1025.com. To the extent that the general contest rules differ from these
rules, these rules will govern and control with respect to this Contest.
How to Enter
1. No purchase necessary.
2. Beginning Tuesday, May 27, 2008 through
Friday, August 29, 2008, Monday through Friday only, when you hear
the “summer of variety sounder” played on WTSS (but not when used in a promotional announcement or advertisement for the contest),
caller #12 to the Station’s contest line at
(716)644-1025 will win the qualifying prize described below, subject to
verification of eligibility and compliance with the contest rules, and will
have a chance to participate in the grand prize event.
The sounder will play once between 6a-9:30a, 9:30-2pm, and 2p-6p for a total of
3 qualifiers per day with the exception on Friday, August 29th when
the sounder will only play one time between 6a-9:30a. Only calls received at the preceding phone number are eligible to
participate in this contest. There
will be up to 205 qualifiers. WARNING:
Online listeners to streamed broadcasts may experience a lag in
transmissions due to buffering limitations.
Contest Participants should not rely on streamed broadcasts.
3. If the Station does
not receive at least 12 calls when a sounder is played, that play of the
contest will not be repeated and no alternative qualifier will be awarded.
How to Win
4. On Saturday, August 30, 2008 beginning at
9am until 10:45am, qualifiers must check-in on-site with Station
representatives in order to participate in the grand prize event occurring at
Darien Lake Theme Park Resort located at 9993 Alleghany Road, Darien Center, NY
14040. Entrants will be required to
line up and check in at the Star 102.5 Kiosk (located right outside the main
gate) to
register, show a valid governmentally issued photo identification to verify age
and state of residency (as required by the contest rules applicable to this
contest), and sign one or more liability release agreement (must be signed “as
is” to participate, and obtain a copy of the contest rules. Failure to sign the required liability
release agreements will result in automatic disqualification and ineligibility
to participate further in this contest.
Timely registered qualifiers who provide all required information will
be deemed “Finalists” and will be entitled to further participate in this
contest. Finalists will be provided with
two tickets to enter the Park on the day of the grand prize event (in addition
to the qualifying prize for tickets for future use).
5. Upon checking in, each Finalist will randomly assigned
a numbered bracelet. The numbers on the
bracelets will determine the Finalist order in line,
beginning with the lowest number selected and proceeding thereafter to the next
highest number.
6. The grand prize
giveaway will begin at approximately 11am. The Finalists will line up according to their bracelet number,
starting with the Finalist who has bracelet number one. In groups of ten, starting with numbers one
through ten, the Finalists will step forward and randomly choose one Perry’s
ice cream sandwich out of a large stationary freezer. The Station will supply ice cream sandwiches
that will equal in number the number of Finalists that check-in on time for the
Grand Prize giveaway .
When Rob Lucas (host of the event) counts to three, the group of ten
qualifiers will open the wrappers to their ice cream sandwiches. Among all ice cream sandwiches contained in
the freezer only one will contain a gold foil star (approximately two inches in
diameter). The Finalist who finds the
ice cream sandwich containing the gold star will be the grand prize winner
(subject to verification of eligibility and compliance with these contest
rules), and the contest shall be immediately over. No other Finalist will be permitted to choose
an ice cream sandwich after that point. Not all Finalists will have an
opportunity to choose a Perry’s ice cream sandwich.
7. AT THE GRAND PRIZE EVENT, THE POTENTIAL GRAND PRIZE WINNER
MUST SELECT WHICH ONE OF THE GRAND PRIZE OPTIONS HE/SHE SELECTS BY SIGNING A
PRIZE ELECTION FORM AND ONCE SELECTED NO CHANGES MAY BE MADE BY WINNER TO THEIR
INITIAL SELECTION.
8. All contest participants hereby agree
to strictly follow all instructions and directions given by the Station event
staff and understand that any intentional failure to comply with the processes,
procedures and instructions at the event may result in immediate
disqualification, in Station’s sole discretion.
9. In the event that
the grand prize event needs to be scheduled for any reason (including, without
limitation, weather or park closing), such postponement will be announced on
air and on the Station’s website. It is
the sole responsibility of each qualifier to check the website and/or listen
on-air for cancellation and/or rescheduling information. Notwithstanding the foregoing, Station will
send a written notice to the address that the Station recorded when the
qualifier first called in with the rescheduled date/time but in no event will
Station or Sponsors have any liability or responsibility for any qualifiers
failure to receive the letter for any reason or a qualifier’s inability to
attend the event on the rescheduled date (and no alternative opportunities will
be offered).
10. Odds of becoming a qualifier depend upon
the number of phone call entries received.
Odds of a Finalist winning the grand prize will be no greater than 1:

Prize(s)
11. Up to 205 qualifying prizes will be awarded in
this contest. Each verified qualifier
will receive a pair of tickets to Darien Lake for the 2008 season valued at $60
per pair, use of which may be subject to certain restrictions, blackout dates
and availability, PLUS Finalists will receive two tickets to Darien Lake for
use on August 30, 2008 in connection with the grand prize event (valued at
$60).
12. Only one grand prize will be awarded in this
contest. The verified grand prize winner in this contest will receive one of
the following (based on the winner’s election pursuant to Section 7
above):
a.
2008 Ford
focus 2-door coupe SES from Basil Ford (MSRP $20,605); OR
b.
2008 Chevy
HHR LT (red) from Joe Basil Chevy ($19,870), features include automatic, power,
bright chrome package and luggage rack; OR
c.
2009 Toyota
Matrix from Mike Basil Toyota ($17,990), features include 5-door, automatic,
and cd/mp3 player; OR
d.
2008 Chevy
Cobalt LT from Robert Basil Chevy ($17,085); features include automatic, remote
start, body-side molding and cruise control, OR
e.
2008 Pontiac
G6 Sedan from Basil
Wellsville ($21,495), features include 6-disc CD and sunroof; OR
f.
$18,000 in
Basil Bucks toward the purchase of any used vehicles from Basil Resale Transit
or Sheridan. Basil Bucks may NOT be
redeemed for cash, have no cash value and may not be transferred. In the event that Winner purchases a Vehicle
worth less than $18,000, winner shall not be entitled to the difference and the
balance shall be forfeited. In the
event that Winner purchases a Vehicle worth more than $18,000, winner shall be
solely responsible for the excess.
The precise vehicle will be determined by Sponsors but winner will
have choice of which of the above 6 vehicles or “Basil Buck” he/she elects. The
selected vehicle (including any vehicle purchased with Basil Bucks, if
applicable) is herein referred to as the “Vehicle.” Prior to being awarded the grand prize,
potential winner must pay (a) all applicable sales tax (between 8% to 8.75% of
the MSRP based on County winner resides in), $195 stock, inspection and
registration fee, (b) sign one or more liability release agreements, affidavits
of eligible and/or prize receipts, and (c) any other document required by Basil
Dealership for the award and transfer of the Vehicle. Winners are responsible for all federal,
state, and local taxes. All
motor vehicle fees are the responsibility of the winner. The
winner shall comply with all Department of Motor Vehicle Insurance Laws, Rules,
and Regulations of his/her state of residence. Grand Prize winner must show
proof of insurance and a valid drivers license at the
time of vehicle delivery. Grand Prize
Winner shall be solely responsible for obtaining and payment of any federal or
state required registration, inspection, insurance coverage, and taxes. In addition, Grand Prize Winner shall receive
an IRS Form 1099 and such prize will be reported to the Internal Revenue
Service for the 2008 tax year for the fair market value of the prize (if Basil
Bucks is selected, based on $18,000 regardless of whether the Basil Buck have
then been redeemed or not). Additional information regarding the warranty,
pick-up/delivery, and other information will be mailed to the winner within 20
business days of winning the prize. Vehicle (or Basil Bucks, if applicable)
will be available for winner no more than 6-8 weeks after all required
documents are complete and verified.
Neither Station nor any Sponsors have made or is responsible in any
manner for any warranties, representations, or guarantees, express or implied,
in fact or law, relating to such Vehicle, including without limitation, its
quality, mechanical condition, merchantability, or fitness for a particular
purpose, with the exception of any standard manufacturer's warranty that may
apply to the Vehicle. NOTWITHSTANDING
THE FOREGOING, ENTRANTS ACKNOWLEDGE THAT THE VEHICLE AWARDED WILL BE THE SAME
VEHICLE DISPLAYED AT VARIOUS LOCATIONS IN PROMOTION OF THE CONTEST AND WILL BE
AWARDED TO THE WINNER "AS IS" AND THE VEHICLE MAY HAVE UP TO 5,000
MILES. Grand Prize Winner will be
required to complete all relevant transfer documents and to be available for
Basil Dealership to contact them with the date and time the prize can be picked
up from the dealership during regular business hours at a mutually agreed upon
date and time within 30 days written notice from Station. Failure to collect the Grand Prize and
deliver all required payments and forms within 30 days of receiving written
notification that the Grand Prize is ready for delivery to Grand Prize Winner
will constitute forfeiture of the Grand Prize.
If forfeited, the Grand Prize will remain the property of the Station
and no other Winner will be chosen.
Photo identification, social security number, and proof of insurance are
required to collect Grand Prize.
